TERMS OF SERVICE

Welcome to PuliPOP. Before you place an order, here is what you are agreeing to. We have tried to keep this readable. If anything is unclear, message us. We answer.

1. WHO WE ARE

These Terms of Service ("Terms") govern your use of pulipopfoods.com (the "Site") and any purchases made through it. The Site is owned and operated by:

Throughout these Terms, "PuliPOP," "we," "us," and "our" refer to PuliPOP Foods LLP. "You," "your," and "Customer" refer to anyone visiting or purchasing from the Site.

2. ACCEPTANCE OF TERMS

By accessing or using the Site, browsing, placing an order, or otherwise interacting with PuliPOP, you agree to these Terms. If you do not agree, please do not use the Site or place orders.

These Terms apply to anyone browsing the Site, placing orders, receiving products purchased through the Site, participating in the POP Squad program, partnering as a Stockist, or interacting with PuliPOP digital channels linked through the Site.

3. ELIGIBILITY TO PURCHASE

By placing an order on pulipopfoods.com, you confirm that:

  • You are at least 18 years of age and legally capable of entering into a binding contract under Indian law
  • You are providing accurate and truthful information including name, contact details, and shipping address
  • You are not purchasing for resale unless you have an approved Stockist agreement with PuliPOP

Purchases by individuals under 18 are not permitted. If we discover an order was placed by a minor, we reserve the right to cancel it and refund the original payment source.

4. NO ACCOUNT REQUIRED

PuliPOP operates on a guest checkout model. You do not need to create an account to place an order. We collect only the information necessary to fulfill your order: name, contact number, email, shipping address, and payment details.

We may introduce account creation in the future at our discretion. If we do, these Terms will be updated and you will be notified.

5. PRODUCTS, PRICING, AND ACCURACY

5.1 Product appearance The actual product may vary slightly from photographs due to natural variations in handcrafted small batch food. Color, texture, and consistency may differ from images. This is expected and not grounds for refund.

5.2 Pricing All prices on the Site are in Indian Rupees (₹) and inclusive of GST as applicable. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time of order placement.

5.3 Product availability We make small batches by hand. Stock can sell out quickly. We reserve the right to limit order quantities, refuse orders, or remove products from sale without notice.

5.4 Errors and corrections If we discover a pricing or product description error after you place an order, we will contact you to correct it before processing. You may choose to proceed with the corrected order or cancel for a full refund.

6. ORDER ACCEPTANCE AND PROCESSING

6.1 Offer and acceptance When you place an order, you are making an offer to purchase. We accept your offer only when we send order confirmation via email or WhatsApp. Automated order acknowledgment from Shopify is not order acceptance.

6.2 Right to refuse We reserve the right to refuse or cancel any order for reasons including but not limited to:

  • Suspected fraud or unauthorized payment
  • Inability to verify shipping address
  • Bulk orders without approved Stockist agreement
  • Orders to embargoed regions
  • Pricing or stock errors
  • Past customer abuse or policy violations

6.3 Order modification Once an order is confirmed, you cannot modify items, quantities, or shipping address. To change anything, cancel the existing order before shipping and place a new one.

7. PAYMENT TERMS

7.1 Accepted payment methods We accept payments through:

  • UPI (Google Pay, PhonePe, Paytm, BHIM, and similar)
  • Credit cards (Visa, MasterCard, RuPay, American Express)
  • Debit cards
  • Net banking
  • Partial Cash on Delivery (Partial COD)

7.2 Partial COD policy For Partial COD orders, you must pay a minimum advance amount (as displayed at checkout) at the time of order placement. The balance is collected by the courier at the time of delivery in cash. If you refuse the delivery or fail to pay the balance, the order is treated as a cancellation and the advance amount is non refundable.

7.3 Payment processing All online payments are processed by third party payment gateways. PuliPOP does not store your card or banking credentials. By making a payment, you authorize the payment gateway to process the transaction on your behalf.

7.4 Failed payments If a payment fails or is reversed, your order will not be processed. You may retry payment or cancel the order.

7.5 Promotional codes and discounts Promotional codes are valid only for the period specified, cannot be combined unless explicitly stated, and may be revoked at our discretion in case of misuse. We reserve the right to cancel orders placed using codes obtained through fraud or system errors.

8. SHIPPING AND DELIVERY

Detailed shipping terms including timelines, costs, free shipping threshold, courier partners, and delivery procedures are covered in our separate Shipping Policy, which forms part of these Terms.

In summary:

  • Free shipping on orders above ₹799 across India
  • Standard delivery: 3 to 5 business days for Tier 1 metros, 5 to 7 business days for other cities
  • Shipping is via third party courier services
  • Risk of loss transfers to you upon delivery to the address provided
  • You are responsible for accurate shipping information

9. REFUNDS, RETURNS, AND CANCELLATIONS

Refunds, returns, and cancellations are governed by our separate Refund and Return Policy, which forms part of these Terms. In summary:

  • Returns are accepted only for damage in transit, wrong product shipped, or lost shipments
  • Claims must be raised within 48 hours of delivery with unboxing video and photo evidence
  • Default resolution is product replacement. Refunds are issued only when replacement is not possible.
  • Order cancellations are permitted only before shipping

By placing an order, you agree to the Refund and Return Policy in its current form.

10. INTELLECTUAL PROPERTY

10.1 Ownership All content on the Site including but not limited to text, graphics, logos, product images, photographs, videos, recipes, brand voice, product names ("Pickles by PuliPOP," "One Pot Meal by PuliPOP," "POP Squad," and other PuliPOP marks), packaging design, and software is the exclusive property of PuliPOP Foods LLP or its licensors.

10.2 Trademarks "PuliPOP," "Pickles by PuliPOP," "One Pot Meal by PuliPOP," "POP Squad," "We make your mind POP," and the chili pepper emoji 🌶️ used as a brand mark are trademarks or trade names of PuliPOP Foods LLP. Unauthorized use is prohibited.

10.3 Permitted use You may view, browse, and use the Site for personal non commercial purposes. You may not:

  • Copy, reproduce, or distribute Site content without written permission
  • Use PuliPOP marks in a way that suggests endorsement or affiliation
  • Reverse engineer, scrape, or systematically extract data from the Site
  • Use Site content for commercial gain

10.4 Limited license We grant you a limited, non exclusive, non transferable license to use the Site for the sole purpose of placing orders and browsing products.

11. USER GENERATED CONTENT

11.1 Reviews, comments, and submissions If you post a review, comment, photograph, video, or other content on the Site, social media tagging PuliPOP, or via direct submission, you grant PuliPOP a perpetual, royalty free, irrevocable, worldwide license to use, reproduce, modify, display, and distribute that content for commercial and marketing purposes.

11.2 Standards for user content By submitting content, you confirm that:

  • The content is your original creation or you have the rights to share it
  • The content does not violate any law, third party rights, or these Terms
  • The content is not offensive, defamatory, misleading, or fraudulent
  • You consent to PuliPOP using your name and image alongside the content

11.3 Right to remove PuliPOP reserves the right to remove, modify, or refuse user content without notice for any reason.

12. PROMOTIONAL PROGRAMS

PuliPOP may operate additional programs from time to time, each with its own specific terms.

12.1 POP Squad (Creator and Influencer Program) A community of creators who partner with PuliPOP through barter and selective paid collaborations. POP Squad members are subject to additional terms shared during onboarding. Participation is at PuliPOP's sole discretion.

12.2 Become a Stockist (Wholesale Program) A program for retailers, gourmet stores, hospitality businesses, and online retailers to stock PuliPOP products. Stockist relationships are governed by separate wholesale agreements executed at the time of partnership.

12.3 Other programs PuliPOP may launch additional programs (subscription clubs, loyalty programs, ambassador programs) in the future. Each program will have its own terms that apply in addition to these Terms. In case of conflict, the program specific terms prevail for that program only.

Participation in any program does not modify your obligations under these general Terms of Service.

13. PROHIBITED USES

You agree not to use the Site for any of the following:

  • Placing fraudulent orders
  • Using stolen payment information
  • Submitting false personal or shipping information
  • Reselling products without an approved Stockist agreement
  • Bulk purchasing for commercial redistribution
  • Interfering with Site functionality or security
  • Posting false reviews or misleading user content
  • Harassing PuliPOP staff or other customers
  • Violating any applicable Indian law
  • Using the Site in any manner that could damage, disable, or impair PuliPOP operations

Violations may result in order cancellation, refund denials, account restrictions, and legal action where applicable.

14. FOOD SAFETY AND DISCLAIMERS

14.1 Product nature PuliPOP products are non vegetarian food items including buffalo meat, chicken, prawn, and anchovy. By purchasing, you acknowledge:

  • You have read product descriptions, ingredients, and allergen information
  • You understand the product is non vegetarian
  • You are not allergic to any ingredients listed
  • You will store the product as per the instructions on the label

14.2 Allergen disclosure Our products may contain fish, shellfish, dairy traces, gluten traces, mustard, and other common allergens. Our manufacturing facility processes multiple ingredients. If you have severe allergies, exercise caution and consult the ingredient list before consumption.

14.3 No medical advice PuliPOP products are food items, not medicines or health supplements. We do not make medical claims. Consult a doctor before consumption if you have specific dietary restrictions or medical conditions.

14.4 Storage and handling Once delivered, you are responsible for proper storage and handling as per the label instructions. Improper storage after delivery is not grounds for refund or replacement.

15. LIMITATION OF LIABILITY

15.1 Maximum liability To the maximum extent permitted by law, PuliPOP's total liability arising out of or in connection with any order shall not exceed the total amount you paid for that specific order, excluding shipping charges and taxes.

15.2 Excluded damages PuliPOP shall not be liable for:

  • Indirect, consequential, incidental, special, or punitive damages
  • Loss of profits, revenue, data, or business opportunity
  • Damages arising from delays caused by third party courier services
  • Damages arising from misuse, improper storage, or consumption against label instructions
  • Damages arising from force majeure events

15.3 Disclaimer of warranties The Site and products are provided "as is" and "as available." Beyond the explicit terms in our Refund and Return Policy, PuliPOP makes no warranties express or implied including merchantability, fitness for a particular purpose, or non infringement.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless PuliPOP Foods LLP, its partners, employees, suppliers, and affiliates from any claims, losses, damages, liabilities, costs, or expenses including reasonable legal fees arising from:

  • Your breach of these Terms
  • Your misuse of the Site or products
  • Your violation of applicable law
  • Your infringement of third party rights
  • Any false statement or misrepresentation by you

17. FORCE MAJEURE

PuliPOP shall not be liable for any failure or delay in performance arising from causes beyond reasonable control, including but not limited to:

  • Acts of God, natural disasters, floods, fires, earthquakes
  • Pandemics, epidemics, or public health emergencies
  • War, terrorism, civil unrest, or government action
  • Strikes, lockouts, or labor disputes
  • Power failures, internet outages, or telecommunications disruptions
  • Courier or logistics partner failures
  • Raw material supply shortages
  • Any other event not within reasonable control of PuliPOP

In such cases, our obligations are suspended for the duration of the force majeure event. Orders that cannot be fulfilled will be refunded.

18. MODIFICATIONS TO TERMS

PuliPOP reserves the right to update, modify, or replace these Terms at any time. Material changes will be communicated via:

  • Updated "Last Updated" date at the top of this page
  • Notice on the Site homepage for at least 30 days following changes
  • Email notification to customers with active orders at the time of change

Continued use of the Site after changes constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, discontinue use of the Site.

19. GOVERNING LAW AND JURISDICTION

19.1 Governing law These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

19.2 Jurisdiction Any disputes, claims, or controversies arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of courts in Thrissur, Kerala, India, with appeals subject to the Kerala High Court at Ernakulam.

19.3 No class actions You agree to resolve disputes individually. You waive any right to participate in class action lawsuits or class wide arbitration.

20. CONSUMER RIGHTS UNDER INDIAN LAW

Nothing in these Terms limits your rights as a consumer under:

  • The Consumer Protection Act, 2019
  • The Food Safety and Standards Act, 2006
  • The Legal Metrology Act, 2009
  • The Information Technology Act, 2000
  • Any other applicable Indian consumer law

These Terms operate in addition to your statutory rights, not in place of them.

21. SEVERABILITY

If any provision of these Terms is found to be invalid, unenforceable, or contrary to applicable law by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

22. ENTIRE AGREEMENT

These Terms, together with the Refund and Return Policy, Shipping Policy, Privacy Policy, and any program specific terms (POP Squad, Stockist, future programs), constitute the entire agreement between you and PuliPOP regarding your use of the Site and purchase of products.

These Terms supersede all prior agreements, communications, or understandings whether written or oral.

23. NO WAIVER

Failure or delay by PuliPOP in enforcing any right under these Terms does not constitute a waiver of that right. Any waiver must be in writing and signed by an authorized representative of PuliPOP Foods LLP.
